TERMS AND CONDITIONS OF SALE AND PERSONALIZATION OF GOODS
(hereinafter referred to as the "Personalization Terms and Conditions")
§ 1.
GENERAL PROVISIONS
1. These Personalization Terms and Conditions define the rules for the sale and personalization of selected goods available in the online store at: https://theodderside.com/, operated by THE ODDER SIDE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Warsaw, at ul. Widok 10 lok. 3A, 00-023 Warsaw, registered by the District Court for the capital city of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under KRS number 0000983656, NIP 7010439296, REGON 147420946, with a share capital of PLN 5,000.00 (hereinafter referred to as the "Organizer").
2. The rules for purchasing goods in the Organizer's online store, including the rights and obligations of the Customer, are defined in the Store Regulations available at https://theodderside.com/pages/regulamin (hereinafter referred to as the "Store Regulations"). These rules shall apply to the purchase of Goods to be personalized, subject to the provisions below. Expressions starting with a capital letter used in the Personalization Regulations have the meaning assigned to them in the Store Regulations, unless the Personalization Regulations explicitly state otherwise.
3. The offer for the sale and personalization of Goods to be personalized is valid from May 15, 2026, until stocks last.
§ 2.
RULES OF SALE AND PERSONALIZATION
1. The Customer has the possibility to personalize and purchase selected goods sold by the Organizer (hereinafter referred to as the "Personalization Service").
2. Goods covered by the Personalization Service are goods available in the Organizer's online store at the address specified in §1 para. 1 of the Personalization Regulations, in the "Shirts" collection or explicitly marked as goods subject to personalization (hereinafter referred to as "Goods to be personalized").
3. To use the Personalization Service, the Customer must select the "Personalize" field on the product page of the Good to be personalized, then choose the thread color and enter the embroidery content in the form provided on that page.
4. The embroidered content can include a maximum of 4 characters (including spaces).
5. The location of the embroidery (right sleeve) is determined by the Organizer and presented to the Customer in the form of a visualization after selecting the elements referred to in paragraph 3 above. The embroidery preview is illustrative.
6. If the Customer does not specify the embroidery content, the Personalization Service will not be performed, of which the Customer will be immediately informed.
§ 3.
PRICE, LEAD TIME
1. The Personalization Service is subject to a fee of PLN 39.00 gross (hereinafter referred to as the "Personalization Fee").
2. After the Customer specifies the personalization elements described in § 2 para. 3 above and adds the Good to be personalized to the Shopping Cart, the Personalization Fee is automatically added to the price of the Good to be personalized.
3. The lead time for the Personalization Service is a maximum of 7 business days from the moment payment for personalization and purchase of the Good to be personalized with the Personalization Fee is credited. In the case of personalization and purchase of several Goods to be personalized, the lead time may be proportionally extended, of which the Customer will be informed in the order confirmation or in an e-mail.
4. For Customers participating in the Organizer's Loyalty Program who have reached level IV – BESTIES, the express shipping option will not be available for the personalization and purchase of Goods to be personalized.
5. If the Customer's order includes both the Personalization Service and the purchase of other Goods from the Organizer's offer, the entire order will be shipped once, after the personalization is completed, taking into account the lead time provided for it.
§ 4.
LIABILITY, COMPLAINTS AND RETURNS
1. The Organizer is not responsible for errors (in particular: typos, incorrect characters, format) made by the Customer when entering the embroidery content. The service will be performed in accordance with the data entered by the Customer in the form on the product page of the Good to be personalized.
2. The Customer bears sole responsibility for the content of the embroidery, in particular for any infringement of third party rights or legal provisions (e.g., offensive, vulgar content, containing trademarks or personal data of third parties).
3. The Organizer reserves the right to refuse to provide the Personalization Service if the embroidery content is unlawful, infringes good morals, or may infringe the rights of third parties. In such a case, the Organizer will immediately inform the Customer of the reasons for refusal and propose changing the content or refunding the funds.
4. Embroidery colors, thread shades, and letter proportions may slightly differ from the visualization referred to in § 2 para. 5 of the Personalization Terms and Conditions, which results from monitor settings and manufacturing technique. Such differences do not constitute a defect of the Good to be personalized.
5. Complaints regarding the quality of the Personalization Service can be submitted in accordance with the rules set out in the Store Regulations.
6. Goods to be personalized are made according to the individual order of the Customer, therefore they are not subject to return (withdrawal from the contract).
§ 5.
FINAL PROVISIONS
1. In matters not regulated by the Personalization Terms and Conditions, the provisions of the Store Regulations and relevant provisions of Polish law, including in particular the Civil Code, shall apply.
2. The Organizer reserves the right to change the terms of sale of Goods to be Personalized or terminate the offer at any time, without giving any reason. Changes do not affect the rights of Customers who placed an order before their introduction.
