TERMS AND CONDITIONS OF THE ODDER SIDE LOYALTY PROGRAM

§ 1. GENERAL PROVISIONS

1. These Regulations define the rules of conducting and participating in the Loyalty Program, organized by THE ODDER SIDE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Warsaw, at the address: ul. Widok 10 lok. 3A, 00-023 Warsaw, registered by the District Court for the capital city of Warsaw in Warsaw, 14th Commercial Division of the National Court Register, KRS 0000983656, NIP 7010439296, REGON 147420946, with the share capital of: PLN 5,000.00.

2. Contact with the Organizer is possible via:

c. contact form available on the Online Store website;

d. chat available on the Online Store website.

3. The Regulations are continuously available on the website www.theodderside.com, in a way that allows obtaining, reproducing and recording their content by printing or saving on a medium at any time.

4. The Regulations specify in particular the rules for the allocation, implementation, complaints and cancellation of Shells (points) accrued in connection with the purchase of Goods.

5. The Loyalty Program is implemented by the Organizer from March 20, 2025 until further notice. The Organizer will inform Participants about the end of the Loyalty Program at least 2 months in advance through information posted in the Online Store or through a message sent to the e-mail addresses of Participants provided by them during Account registration.

6. Acceptance of the Regulations is voluntary, but necessary in order to use the Loyalty Program.

§ 2. DEFINITIONS

1. Organizer – The Odder Side Spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, ul. Widok 10 lok. 3A, 00-023 Warsaw, KRS 0000983656, NIP 7010439296, REGON 147420946, e-mail address: hello@theodderside.com, contact telephone number: +48 882 124 830. The Organizer is also the Seller;

2. Loyalty Program – a discount program conducted by the Organizer in the Online Store, intended for users of the Online Store, conducted under the principles specified in the Regulations;

3. Regulations – these regulations;

4. Store Regulations – regulations of the Online Store available at https://theodderside.com/pages/regulamin ;

5. Goods – a product presented in the Online Store, the description of which is available for each of the presented products;

6. Online Store – online store operated by the Organizer at https://theodderside.com/;

7. Participant – a Customer who has agreed to participate in the Loyalty Program and has an Account in the Online Store;

8. Account – a part of the Online Store assigned to a given Customer, through which the Customer can perform specific actions within the Online Store. The Customer gains access to the Account using the Login and Password. The Account allows for saving and storing information about the Customer's address data for shipping Goods, tracking the status of the Order, accessing the Order history and other services provided by the Seller;

9. Shells (Points) - points awarded under the Program to Participants for purchases in the Online Store or for the Participant's activities specified in the Regulations, which are exchanged for amount discounts on the principles described in the Regulations.

Any other provisions written in capital letters in the Regulations and not specified in this paragraph should be understood in accordance with their definitions set out in the Regulations of the Online Store available at https://theodderside.com/pages/regulamin .

§ 3. RULES OF PARTICIPATION IN THE LOYALTY PROGRAM

1. Participation in the Loyalty Program is free and voluntary.

2. The loyalty program consists in awarding Shells (points) to Participants who place orders for Goods in the Online Store under the terms and conditions specified in the Regulations.

3. A Customer who has a registered Account in the Online Store may participate in the Loyalty Program.

4. In order to join the Loyalty Program, the Customer:

1) agrees to participate in the Loyalty Program when registering an Account in the Online Store, or

2) if he/she already has an Account, selects the appropriate consent displayed after logging in to the Account.

5. The Participant may, without giving any reason, resign from participating in the Loyalty Program at any time by sending an appropriate message to the following e-mail address: hello@theodderside.com

6. The Account registration procedure is specified in the Regulations of the Online Store.

§ 4. RULES FOR AWARDING SHELLS (POINTS) IN THE LOYALTY PROGRAM

1. For the purchase of Goods in the Online Store during the Loyalty Program, the Participant is awarded points on the terms specified in the Regulations.

2. For every PLN 1.00 (one zloty) spent during a single transaction in the Online Store, the Participant receives 1 (one) Shell (point), with the proviso that the Participant who has reached the PARTNER IN CRIME level receives 1.25 Shell (points), and the Participant who has reached the BESTIES level receives 1.5 Shell (point),

3. If the transaction amount is expressed in partial zlotys, the amount on the basis of which Points will be awarded is reduced to full zlotys. The basis for calculating Points is the gross amount visible on the fiscal receipt.

4. Shells (points) are calculated after 30 days from the date of placing the order by the Participant. If the Participant provides his/her date of birth, the Participant will receive additional points provided for in the Regulations within 30 days from the date of his/her birthday.

5. If the Participant exercises the right to withdraw or return purchased Goods (if such right is available to them), the Shells (points) awarded for this purchase will be canceled. If the withdrawal concerns part of the order, then only Shells (points) corresponding to the price of the returned Goods determined on the basis of the receipt will be deducted, with the proviso that 1 Shell (point) is equivalent to PLN 1.00.

6. Regardless of the above, the Organizer awards additional Shells (points) on the following terms:

1) newsletter subscription – the Participant receives 40 Shells (points),

2) The Participant who provided his/her date of birth on the occasion of his/her birthday receives 500 Shells (points);

3) following the Organizer’s profile on the TikTok platform via the link available on the Account – 20 Shells (points);

4) following the Organizer’s profile on the Instagram platform via the link available on the Account – 20 Shells (points);

5) liking the Organizer’s profile on the Facebook platform via the link available on the Account – 20 Shells (points);

6) points for placing the first order – 500 Shells (points);

7) recommendation of a friend – the Participant may generate a link and pass it on to his/her friend so that he/she can place his/her first order in the Online Store. The order must be placed via the link referred to in the previous sentence. If the Participant's friend makes purchases in the Online Store, the recommending Participant will receive 500 Shells (points). In the event that the order or part thereof is returned by the Participant's friend who made the purchase in accordance with the previous sentence, the points will not be awarded.

7. Each Participant receives additional Shells (points) after reaching the next level in the Loyalty Program, in accordance with § 5 of the Regulations.

8. Each Participant has the opportunity to check the number of Shells (points) obtained after logging in to the Online Store and exchange them for discounts specified in § 6 of the Regulations.

9. The Organizer reserves the right to exclude the awarding of Shells (points) for the purchase of certain Goods, which will be announced in the description of each such Good.

10. In addition to concluding sales agreements for Goods via the Online Store, the Participant also has the opportunity to obtain additional Shells (points) by participating in separate promotional campaigns conducted by the Organizer or its partners – on the terms indicated in a given campaign.

11. Each Shell (point) is valid for 12 months from the moment it is obtained by the Participant. After this period, the Shells (points) lose their validity.

12. Points collected by the Participant cannot be exchanged for cash, shopping vouchers or any other forms of compensation.

§ 5 LOYALTY PROGRAM LEVELS

1. The Loyalty Program consists of 4 levels – the Participant reaches a specific level depending on the number of Shells (points) collected. At each level of the Loyalty Program, the Participant receives additional benefits indicated in the Regulations.

2. Level I - NEW FRIEND - available to the Participant who joined the Loyalty Program and made purchases in the Online Store for a total amount of up to PLN 2,999.00.

3. Level II - CLOSE CIRCLE - available to the Participant who has made purchases in the Online Store for a total amount of PLN 3,000.00. Starting the CLOSE CIRCLE level, the Participant receives a one-time bonus of 500 Shells (points).

4. Level III - PARTNER IN CRIME - available to the Participant who has made purchases in the Online Store for a total amount of PLN 8,000.00. Additionally, the Participant at the PARTNER IN CRIME level receives 1.25 Shells (points) for every PLN 1.00 (one zloty) spent and free shipping of Goods from the Online Store, early access to new products in the Online Store and a one-time bonus of 1,000 Shells (points). Information about new products will be available in the Account after logging in;

5. Level IV – BESTIES – available to the Participant who has made purchases in the Online Store for a total amount of PLN 20,000.00. The Participant at this level receives 1.5 Shells (points) for every PLN 1.00 (one zloty) spent and a one-time bonus of 3,000 Shells. The Participant at the BESTIES level also receives free and express shipping of Goods, early access to new products in the Online Store and invitations to events selected by the Organizer, implemented with the participation of external partners, including events of a larger scale and mass or open nature. Information about new products and invitations will be visible in the Account after logging in.

§ 6 RULES FOR USING SHELLS (POINTS)

1. The Participant may exchange the collected Shells (points) for discounts on the purchase of Goods in the Online Store in the amount specified below:

500 Shells (points) – discount of PLN 20.00 (twenty zloty);

· 1000 Shells (points) – discount of PLN 40.00 (forty zloty);

2000 Shells (points) – discount of PLN 80.00 (eighty zlotys);

2. In order to use Shells (points), when making a purchase in the Online Store, the Participant should select the appropriate checkbox in the order form expressing the will to use the Shells (points) collected by the Participant and the number of Shells (points) they wish to use.

3. After completing the actions indicated in section 2 above, a discount corresponding to the number of Shells (points) indicated by the Participant will be automatically calculated in the Basket.

§ 7 COMPLAINT PROCEDURE

1. The Participant may submit a complaint regarding the manner of conducting the Loyalty Program.

2. The complaint should be sent to the Organizer in writing to the following address: THE ODDER SIDE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, THE ODDER SIDE Kopytów 44F/Procan, 05-870 Kopytów, e-mail address: hello@theodderside.com, telephone number +48 882 124 830.

3. In the complaint, the Participant should provide his/her name and surname, correspondence address, type and description of the problem, as well as the request related to the complaint submitted.

4. If there are any deficiencies in the complaint, the Organiser will request the Participant to supplement it to the extent necessary within 7 days from the date of receipt of the request by the Participant, instructing them that failure to supplement the necessary information will result in the complaint not being considered.

5. The Organizer will respond to the complaint within 14 days of receiving it. In the absence of a response within the aforementioned period, it is considered that the Organizer has accepted the complaint.

6. The Organiser will respond to the complaint in the same manner in which it was received (i.e. by traditional mail or electronically), unless the Participant has expressly stipulated how he or she is to be contacted.

§ 8 WITHDRAWAL FROM THE LOYALTY PROGRAM

1. In the event of deletion of the Account, the Participant resigns from participation in the Loyalty Program.

2. The Participant may, without giving any reason, resign from participating in the Loyalty Program at any time by sending an appropriate message to the following e-mail address: hello@theodderside.com

3. Deleting the Account in the Online Store or resigning in the manner indicated in section 2 above will result in the Participant losing all Shells (points) collected on his Account.

4. A Participant who has resigned from participating in the Loyalty Program by deleting their Account may rejoin it by re-registering their Account in the Online Store.

5. A Participant who has resigned from participating in the Loyalty Program by deselecting the consent to participate therein may rejoin it by selecting the consent to participate in the Loyalty Program located in the Account after logging in.

6. Participants returning to the Loyalty Program are not entitled to Shells (points) they have not previously used before resigning from the Loyalty Program.

§ 9. PERSONAL DATA PROTECTION

The Organizer collects and processes personal data provided by Participants in accordance with applicable legal regulations and in accordance with the Privacy Policy, available on the Online Store website at the link: https://theodderside.com/pages/polityka-prywatnosci-1

§ 10. FINAL PROVISIONS

1. In matters not regulated in the Regulations, the provisions of the Regulations of the Online Store, the provisions of the Civil Code, the provisions of the Act on the provision of services by electronic means, the provisions of the Consumer Rights Act and other relevant provisions of Polish law shall apply.

2. The Organizer is entitled to terminate the Loyalty Program at any time for important reasons, in particular:

a) a change in generally applicable legal provisions affecting the Loyalty Programme and the possibility of its continuation or resulting in the necessity to terminate it;

b) economic unprofitability of the Loyalty Program;

c) introduction of another loyalty program by the Organizer or other forms of sales support.

3. Participants will be informed of any changes to the Regulations via a message sent to the e-mail address they provided at least 14 days in advance.

4. The Regulations are available at the Organizer's registered office, in the Online Store and on the Account in a format enabling their download.

5. The Regulations enter into force on 27 March 2025.
